Regulation of the Administrative Committee of Guangzhou-Hong Kong Intelligent Manufacturing Cooperation Zone of Guangzhou Development District [2023] No. 1

All departments involved in the district,

After thorough review and approval by the Administrative Committee of Guangzhou Development District and the People's Government of Huangpu District, Guangzhou City (hereinafter referred to as the District), the Measures to Support Second-stage Entrepreneurship of Enterprises in the West Zone of Guangzhou Development District and Huangpu District, Guangzhou City (hereinafter referred to as the Measures) are hereby issued for implementation. Please conscientiously implement the Measures following the actual situation. In case of any issues arising during the execution, please report them promptly to the Administrative Committee of Guangzhou-Hong Kong Intelligent Manufacturing Cooperation Zone or the Xiagang Sub-District Office for resolution.

Measures to Support Second-stage Entrepreneurship of Enterprises in the West Zone of Guangzhou Development District and Huangpu District, Guangzhou City

Article 1 Purposes

In line with the overall requirements of the Central Committee of the Communist Party of China and provincial/municipal authorities for advancing high-quality development, the District is striving to break new ground for high-quality development. Based on past achievements, the District endeavors to propel a "Second-stage Entrepreneurship" initiative, using the West Zone of Guangzhou Development District as a pilot area to promote innovative development and accelerate the establishment of a modern industrial system supported by the real economy, to transform this takeoff zone of Guangzhou Development District into a new hub of development. In light of the actual conditions in the District, the Measures are hereby formulated. 

Article 2 Scope of Application

The Measures apply to various entities, including industrial enterprises, modern service enterprises, headquarters enterprises, high-tech enterprises, and institutions that possess economic relationships within the scope of the West Zone of Guangzhou Development District (specifically speaking, within the jurisdiction of Xiagang Sub-District), are engaged in normal production and business activities, and comply with relevant regulations on credit management. 

Article 3 Enhancement of Land Acquisition and Storage

By the principle of "acquiring and storing all land resources available," the expired and underutilized land within the scope of the West Zone of Guangzhou Development District shall be actively acquired and stored, to improve the land utilization efficiency in the zone. (Responsible entities: the District Bureau of Planning and Natural Resources, Xiagang Sub-District)

Article 4 Support for Leading Enterprises in Building Industrial Parks

Support shall be provided for leading enterprises with an annual output value of RMB 1 billion or more, or an annual sales volume of RMB 20 billion or more, to establish industrial parks. These leading enterprises are also encouraged to enhance land utilization efficiency through methods such as renovation, expansion, optimization, and multi-dimensional development. Support shall be given to land applications from leading enterprises proposing capital increase, production expansion, or joint construction of industrial parks with key upstream and downstream enterprises in the industrial chain.

Leading enterprises are further encouraged to utilize their existing land to construct industrial parks. Upon approval by the administrative committee and district government for the projects they introduce, support shall be provided for customizing the construction of factory buildings. Additionally, segmented property rights transfer plans shall be determined by regulations based on the requirements of new projects. Article 5 Support for Enterprise Transformation and Upgrading

Support shall be provided for enterprises using existing land to phase out outdated products, technologies, process equipment, and production lines, thereby promoting land redevelopment. In cases where transformation and upgrading require the reconstruction of manufacturing plants and production lines, enterprises are required to submit new project plans to the district administrative authorities. The plans shall undergo standard approval procedures, and support shall be extended to include the administrative approval processes for the planning and construction of new projects under a green channel. (Responsible entities: the District Bureau of Industry and Information Technology, the District Bureau of Planning and Natural Resources, and the District Government Services and Data Management Bureau)

Article 6 Support for the Redevelopment of Existing Land

A joint regulatory mechanism on land-related equity transfer that involves planning and natural resources departments, industry and market supervision departments, and other administrative authorities shall be established.

Support shall be provided for enterprises to introduce new projects that meet the project admission standards of the District through methods such as equity participation and equity transfer through self-owned land use rights. The enterprises shall submit the new project plans to the district industrial administrative department for review. After approval from the administrative committee and district government, administrative approval procedures related to planning, construction, and other matters shall be then processed.

Support shall be given to enterprises for the overall transfer of land use rights to projects that meet the project admission standards of the District. The enterprises shall submit the proposed transfer project plans to the district industrial administrative department for review. After approval from the administrative committee and district government, the transfer shall be then implemented through market transactions. For transfer projects approved, the transferee shall sign a regulatory agreement with the relevant district departments, to specify requirements related to investment, output, taxation, and provisions for handling breaches. Article 7 Establishment of an Inter-departmental Consultation Mechanism for Second-stage Entrepreneurship of Foreign-Funded Enterprises

Strong support shall be provided for existing foreign-funded enterprises to expand new products and new capacities, enhance innovation and R&D capabilities, as well as pursue green and digital transformations.

For projects related to capital increase and production expansion, innovation and R&D, and green and digital transformation, with an investment of over RMB 50 million by existing foreign-funded enterprises, the enterprises shall submit relevant project plans to the corresponding service commissioner. The special enterprise service team of the West Zone shall then organize administrative departments regarding industry, planning, construction, project approval, etc. to conduct on-site inter-departmental consultations and give suggestions on project approval, construction acceptance, and the application for supportive policies at all levels and on all fronts, to expedite project approval, construction, and production. (Responsible entities: the District Development and Reform Bureau, the District Investment Promotion Bureau, the District Bureau of Science and Technology, the District Bureau of Industry and Information Technology, the District Bureau of Planning and Natural Resources, the District Bureau of Housing and Urban-Rural Development, the District Bureau of Commerce, the District Bureau of Emergency Management, the District Bureau of Private Economy and Enterprise Service, the District Bureau for Market Regulation, the District Government Services and Data Management Bureau, Xiagang Sub-District, and the Administrative Committee of Guangzhou-Hong Kong Intelligent Manufacturing Cooperation Zone)

Article 8 Establishment of a Joint Investment Attraction Mechanism for Existing Factory Building Properties

A joint investment attraction mechanism shall be established involving the administrative committees of industrial parks, sub-district offices, and existing factory building leasing enterprises. The special enterprise service team of the West Zone shall collect and publicly regularly release leasing information for factory properties in the West Zone, and organize project matchmaking activities. Rapid channels for project introduction and implementation shall be established in collaboration with various investment attraction departments, industry associations, and investment promotion companies, to introduce high-quality industrial projects into existing properties. (Responsible entities: the Administrative Committee of Guangzhou-Hong Kong Intelligent Manufacturing Cooperation Zone and Xiagang Sub-District)

Article 9 Enhancement of Housing for Employees

To further increase the supply of local indemnificatory rental housing, support shall be provided for transforming idle commercial properties into employee dormitories, to ensure the provision of indemnificatory rental housing for enterprise employees. (Responsible entities: the District Bureau of Housing and Urban-Rural Development, Xiagang Sub-District, and the Administrative Committee of Guangzhou-Hong Kong Intelligent Manufacturing Cooperation Zone)

Article 10 Support for the High-Quality Development of the Huangpu Comprehensive Bonded Zone

The innovative exploration of "bonded +" import and export trade shall leverage the Guangzhou Huangpu Comprehensive Bonded Zone and the Red Wine Culture Street to create a new consumption model for "bonded exhibition + cross-border e-commerce" direct-purchase stores, which integrates front-end stores, back-end warehouses, offline experiences, and online ordering.

Advanced and certified enterprises in warehousing and logistics with a complete information system in the Guangzhou Huangpu Comprehensive Bonded Zone are encouraged to integrate the warehouse management system (WMS) with customs networks to establish a global B2B supply chain comprehensive service platform. The international consolidation and distribution services for consumer products and bulk commodities are also encouraged, to create a global resource allocation center and an open gateway hub. Article 11 Establishment of a High-Quality Tax Service Mechanism for the Entire Process

Tax authorities shall provide proactive guidance for complex tax-related projects such as investment attraction, expansion or construction of large-scale production lines of enterprises, redevelopment of existing land, investment increase and production expansion by foreign-funded enterprises, and the layout of new production capacity, and offer tailored tax policy guidance to enterprises. The complex tax-related procedures throughout the project process shall be simplified, and the processing time shall be reduced to serve the high-quality development of the real economy. Article 12 Miscellaneous Provisions

For the same project or matter that is qualified for support by both the Measures and other supportive policies of the District (including the incentive policies of higher authorities that require the District to offer support or funds), the "higher reward and non-repetition" principle shall prevail, unless it is otherwise stipulated. The establishment of new branches, changes in names, business splits, etc., by enterprises within Guangzhou Development District and Huangpu District, Guangzhou City, which are not within the scope of support under the Measures, are excluded. The Measures shall come into effect from the date of issuance and will be valid for three years.
