Fujian province has adopted a new work permit policy for foreigners in China, replacing the Employment Permit for Foreigners and Foreign Expert Work Permit, as decided by the State Council and the provincial system reform offices and arranged by the State Administration of Foreign Experts Affairs (SAFEA), and Fujian Department of Human Resources and Social Security (HRSS).
The new policy takes effect from April 1, 2017, and the relevant matters are as follows.
I. Application, acceptance, and approval work will start from April 1, 2017 and specific guides will be issued in the near future and published on the websites of the Fujian provincial HRSS department and Fujian Administration of Foreign (Overseas) Experts Affairs. Approvals of new work permits will be handled respectively by foreign expert offices of local human resources and social security departments, the Party affairs office of the Pingtan Comprehensive Pilot Zone, and administrative committees of Fuzhou, Xiamen, Pingtan sections of the Fujian Free Trade Zone. In accordance with the principle of localized management, agencies in Fujian directly under the provincial or central government should apply to above-mentioned local agencies for foreigner work permits.
II. According to the arrangements of SAFEA and for the continuity of work and an orderly transition, April 1 to June 30 will be a transitional period for the new system. During that time, applications for the two old work permits will still be processed, but according to regulations and procedures of the new one. From July 1, 2017, there will be no more issuance of old work permits and foreign expert certificates. Holders can still use old ones until they expire or choose to renew them.
III. Given that some places are temporarily unable to handle applications for new work permits, during the transition period, the foreign expert windows at the Administrative Services Center of Fujian provincial HRSS department will accept and process applications for both old and new ones. Services for old ones will stop on July 1. Employers should apply to local agencies mentioned above.
